POLS FIGHT GOV'S GAY-WED ORDER

ALBANY - Gov. Paterson's controversial order that state agencies recognize out-of-state and foreign gay marriages was challenged in state Supreme Court yesterday by five Republican lawmakers and the head of the Conservative Party.

The lawsuit, filed in The Bronx, charged Paterson violated state law as well as the state Constitution's separation of powers principle when he announced the order last week.

"He should bring this to the Legislature and have us vote on it if he believes this is something of importance to New York," said Sen. Martin Golden of Brooklyn, one of the litigants.
